There has been a spate of fraudulent claims related to pavement tripping cases.
It is not unknown for a person who has sustained an injury in an entirely blame free accident situation to then go and find a defective pavement and to claim that the accident occurred as a result of tripping on the pavement and then bringing the claim against the local authority.
The rise in fraudulent claims like this has resulted in many local authorities adopting a ‘zero tolerance’ approach to claim fraud. All evidence, including medical records, is checked thoroughly and fraudulent claims are referred to the police. There have been several successful prosecutions.
