If you have tripped on a poorly maintained pavement, you are not automatically entitled to compensation. The following matters have to be proved:
• That there was a drop in level of at least...
• Or that the pavement was in such a poor and degraded state that an accident was foreseeable;
• That the local authority do not have a proper system of checking and maintaining the pavement;
• That you were taking a reasonable look out for yourself (if not, up to 50% of your damages could be deducted.
