Seatbelts

If you were in a road traffic accident and not wearing a seatbelt you would be forgiven for thinking that you would not get compensation but this is not the case.

The leading case of Froom-v-Butcher states that you should lose no more than 25% of your damages for this contributory negligence.

Even then it must be proved that wearing the seatbelt would have reduced your injuries significantly.
