What happens if my case is successful?
You get all of your damages, it is as simple as that; 

What are my chances of success?
The solicitors will only take your case on if they think there is a good chance of success. Otherwise, they cannot get paid. Therefore you should have a better than 50% chance of succeeding in your case.

What happens if my case is unsuccessful?
First of all there will be nothing to pay by yourself – the solicitor agrees not to take any fee if the case is unsuccessful and we will insure you (at no cost to yourself) against any other risks;

How will I know why my case has failed?
Most cases fail because new evidence comes to light during the preparation stage which leads the solicitor to believe that there is now a less than 50% chance of success. All the solicitors undertake to give a full verbal and written explanation to you if this situation arises.

How do you and the solicitors get paid?
All the solicitors that we deal with are experts in their field and if they take your case on will do so on the agreement that they will only get paid if they win the case for you. So there is no risk to you.

All the costs of the case are funded by the solicitor and they get paid back at the end by the person you are claiming against (usually an insurance company). 

Therefore the solicitors agree not to make any deductions from your compensation.

How long will my case take?
The quick answer to this is between 6 months and 2 years depending on the type of your case – as everyone knows, insurance companies do not like paying out money! They have to be persuaded to do so and sometimes legal proceedings have to be threatened or started. This means that a formal process has to be gone through in which evidence to your case is collected and presented. Even when an insurance company knows it is going to have to pay you some compensation, they may fight long and hard over the precise amount that is due to you. Complex cases involving very serious injury can take over 2 years.

How do I cope financially whilst I am waiting for my case to resolve?
Very simple cases are over quickly – see above. In more complex or serious cases it is often possible for your solicitor to negotiate an interim payment from the insurance company in expectation of the final settlement. This is especially true when it is only the amount of the compensation that is in dispute;

How much compensation will I receive?
Obviously the answer to this depends very much upon the type of injury that you have sustained and your particular circumstances. One striking feature of the UK law is that the compensation is tailored to meet the individual needs of the injured person. The aim of compensation is to put you in the position you would have been in if the accident had not occurred. This, of course, is impossible but it gives a starting point for the calculation of your compensation claim and can include such things as:

  • Rehabilitation
  • Therapy
  • Special equipment
  • Special transport needs
  • Special accommodation needs
  • Loss of earnings
Will I have to be examined?
Usually your solicitor will want you examined by one of their own doctors in order to provide a full report detailing all of your injuries. Usually an appointment can be made locally to you.

Is anything else required of me?
Your solicitor will usually take a statement from you to cover all the circumstances of the accident and the effects that it has had on you. You should also retain all your receipts and details of any expenditure which you have made which you would not have made if you had not had the accident.
