In August 2005 an employee of a construction company succeeded in bringing a claim against his employer. The employer had left a drop on either side of a ramp so that the employee’s dumper truck had overturned. The High Court held that the company could have taken simple steps to make sure that the site was safe. It had also breached the relevant Health and Safety regulations.
